1. Scope
These General Terms and Conditions (GTC) apply to all orders placed by customers via the ARDUGA AG online shop (Hagenholzstrasse 80, 8050 Zurich). Deviating or supplementary conditions of the customer do not apply unless we have expressly recognized them in writing.
2. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer but a non-binding online catalog. By clicking the "Buy" button, you place a binding order for the goods in the shopping cart. Confirmation of receipt of the order follows immediately after sending the order. A binding contract is only formed when we accept the order with an order confirmation via email or deliver the ordered goods.
3. Prices and Shipping Costs
All prices are in Swiss Francs (CHF) and include the statutory value-added tax (where applicable). The respective shipping costs, which are clearly communicated to the customer during the ordering process, are added.
4. Delivery Terms
We deliver to addresses in Switzerland, the Principality of Liechtenstein, Germany and Austria. Within Switzerland delivery usually takes 2 to 3 working days unless a different period is stated in the shop; for deliveries to Germany and Austria, customs clearance and delivery in the destination country are added to this. For deliveries abroad, import VAT and customs clearance fees apply and are borne by the recipient (section 3 of the Delivery Terms). Should an item be unavailable, we will inform the customer immediately.
5. Payment Terms
Payment can be made by credit card (Visa, Mastercard), Twint, PayPal, Apple Pay, Google Pay, Amazon Pay or Link, processed via our payment provider Stripe. The purchase price is due immediately at checkout. We do not currently offer payment by invoice.
6. Gift Vouchers
Gift vouchers are delivered as a PDF by email and are valid for 3 years from the date of purchase; the expiry date is printed on the voucher. They can be redeemed for products in the online shop at arduga.com, not for shipping costs. They cannot be exchanged for cash. If an order does not use up the full voucher value, the person redeeming it receives the remaining balance as a new voucher code by email; it is valid until the expiry date of the original voucher. Vouchers are transferable. We are not liable for lost voucher codes.
7. Liability
We exclude all liability (including negligence), to the extent permitted by law, for damages resulting from our services, products, or the use of the website. Excluded from this is liability for intentional or grossly negligent behavior. Any liability for auxiliary persons is also entirely excluded.
8. Applicable Law & Jurisdiction
These GTC and all legal relations between ARDUGA AG and the customer are exclusively subject to Swiss law. The exclusive place of jurisdiction for all disputes arising from the contractual relationship is Zurich.
